Yes, that's the issue with us initiating a conventional strike (or them starting one). The scenario of them launching an ICBM at us is an entirely different story, however. USA's nuclear deterrent policy is that we won't use nuclear weapons first and we won't use them at all against a non-nuclear state. NK is now a nuclear state, so we would definitely use nukes against them in the event they launched at us first. If we DON'T respond in kind with a nuclear retaliatory strike, it defeats the whole purpose of deterrence. NK knows this, we know this and that's why they wouldn't dare launch even a bottle rocket at us.
