Being on a road doesn't give you an excuse to accelerate into other cars or people. The opposite is your task as a driver: to go as slowly as conditions require. Also, the contact from the back was as he was accelerating. He was clearly going way to fast for the situation, which to me looks like evidence of intent to ram a large, visible crowd of people.
