It has nothing to do with regulations. Shale oil needs to stabilize above $60 a barrel to be profitable. It has been around $45-50 this year.
The main difference is the cost to 'wash' the sand out of the oil. That extra process affects margins in tight markets like this.

Think about it. If you lost everything suddenly, you wouldn't become homeless.
