That's what they've been trying to do with the Russia narrative. They know they can't beat Trump's appeal with the working and middle classes, so they want to spin him into an enemy.
Taking their accusations to court would be a huge gamble. Anyone with a working knowledge of computers can disprove everything in 5 minutes. They would be relying on the arbiters being too old and/or too ignorant to know what anyone was talking about. If they lose the case, their credibility takes such a hit that not even the fakest news could cover their asses.
So they keep doing nothing. Even though they claim the President is a double agent of a hostile foreign power, which happens to be the 2nd strongest country in the world and the only one who has any chance of defeating us in a war, they're just sitting on their asses. They claim to have absolute proof, but haven't filed any charges against Trump. Why? Because they know they would probably lose!
This is where McCarthyism comes in. Instead of trying to frame Trump and Putin of an imaginary crime, they want to eliminate that step altogether. If they can convince everyone that Russia is a legitimate enemy, they don't need to prove anything. All they need to do take a few photos of Trump with Russian diplomats, then fire up the witch hunt. Plus, they can take whatever action they want against Russia, whether it be sanctions or an all-out declaration of war.
That's why the agencies have been so passive about this "huge scandal". They're biding their time, building up this fake conspiracy with conveniently "leaked" reports. They write whatever they want, because A. They aren't officially releasing them, so they don't have to assume responsibility and B. Nobody reads the fucking sources anyway.
Well that's a lovely thought. Unfortunately it's never going to happen. The future is a corporate dystopia and there's no way around that because the power structures protect and enrich the worst element of mankind and that has consequences for everyone.
