Patents should be illegal. If someone comes up with an idea for something a week after someone else, there shouldn't be a piece of paper saying the first person gets to sit on it and control the market as long as he wants for no good reason. The markets should decide which product is better.
No. Patents and intellectual property still may be necessary to foster individual creativity and innovation. But their duration should be significantly reduced. The rationale is: the government will protect your right to profit off of your innovation/creativity, but not for too long.
