The ending was kinda shit, since Light, as smart as he is made out to be, should have told his right hand man to always have a paper of the notebook with him. The same way he kept a piece in the watch.

It's not 100% sure but in the manga epilogue Matsuda tells he's certain Near used the Death Note because Mikami died a few days later in prison and Near burned the Death Note as soon as he found out it wouldn't make more victims.

His soul is going to nothingness, not because he used the Death Note but because paradise/hell don't exist in Death Note universe, Light figured it out at the very beginning and rethinks about it as he's about to die like a dog. The ending is a lot better in the manga desu

The basic idea of the story is to retell Sherlock Holmes from the point of view of Moriarty, with grimdark/magic elements folded in. Sort of like how Batman always lets the Joker live, because they have fun together and there's no one else in the world like them, Sherlock will always keep Moriarty around. But the reverse isn't true. They aren't just perfect mirrors of each other, and Moriarty will kill his rival and friend and then be left alone to suffer for it. Which is the only actual punishment there is for a character like that. So by reversing the expectatation, it actually reinforces the original concepts and turns a victory into a profound loss, and makes a grimdark twist into a kind moralistic one. It's not high literature, but that's the kind of storytelling turns that people like in mysteries, and the books and show did it well (and then kind of fell apart, but whatever).

I don't think it's ever said how people become shinigamis, we just know about a few of them in the show/the bonus book, and there's also their king, I don't think there's much more to that
