God given is in the Declaration of Independence. The Constitution just assumes it. There's a hundred or so years of philosophy called the Enlightenment that these thoughts come out of. These documents are hardly alone in that period. And are still true today.

Negative doesn't necessarily mean bad,here it just means forbidden. A negative right is something the government isn't allowed to do to you. A positive right is something they must give you. The Bill of Rights is all about things the government isn't allowed to do to you.
