"Reforms to end the "meal ticket for life" maintenance awards on divorce will be put before parliament in the new year in a move that would mirror Scottish laws which favour a "clean break".

Baroness Deech is promoting a private member's bill to end the "disproportionate" awards to some former spouses and make prenuptial contracts binding — a reform that is backed by the Law Commission and many top legal profession figures.

"Our existing law urgently needs reform because of changes in society and families, judicial inconsistencies and excess of judicial discretion," said Lady Deech, a crossbench peer and former chairwoman of the Bar Standards Board, which regulates barristers in England and Wales.

"It is no credit to English law and damaging to the position of all women to find that the wives of foreign oligarchs are having their 'needs' — such as £2 million a year for travel, £100,000 for handbags — taken seriously by judges, while women who are supporting themselves in their jobs at the time of divorce are treated less generously than those who have given up work."

Maintenance, said Lady Deech, should be limited to five years unless exceptional hardship was established. "As long as we expect women to have dignity and go out to work, then it is not right to say 'this man must keep you for the rest of your life'."

The present discretionary system also meant that couples went to court to battle over payments and used up most of the marital assets in legal costs.

Mills, 50, founder and chairman of a firm of eco-spatial surveyors in Surrey, told The Times that he had been left feeling "desperately disappointed" and "with no incentive to work, plan or look at my financial future.

He said that for a marriage lasting 13 years he had already been paying for 15 years "and there is no end in sight. This will continue and leave me facing the prospect of her coming back for even more when I have no control over her finances or spending".

His hope is that the Court of Appeal ruling will be set aside. But whatever happens in court, he says, parliament needs to look at the whole issue of awards on divorce and how long maintenance should continue so that ex-spouses cannot return years later for a second "bite of the cherry".

Mill goes on to say that "a change in the law is needed, for sure. If change does not happen the courts are not encouraging people to work nor to be independent".

Lawyer report rise in prenup contracts

Prenuptial contracts are significantly on the rise, according to a recent survey of 25 law firms involving 200 family lawyers.

Two thirds of respondents, representing hundreds of family lawyers, confirmed a significant increase in the use of prenups by their clients since the landmark ruling seven years ago in the UK Supreme Court.

That case, involving the German heiress, Katrin Radmacher, and her banker-turned-student husband Nicolas Granatino, said for the first time that such agreements had compelling weight. However, the ruling did not go as far as giving them statutory force.

Of the family law firms surveyed, 98 per cent said that they had been instructed on new nuptial agreements in the past 12 months. Of those, 44 per cent had been instructed on six or more new nuptial agreements and 13 per cent had advised on 16 or more.

Postcode lottery over splitting divorce assets

Divorcing couples who go to court for a ruling on how their assets should be split face a postcode lottery, lawyers say.

Judges have wide discretion in England and Wales and courts also vary in attitude, in part by the geographical area of the country. A survey of family lawyers based on 700 cases found that in London and big cities such as Manchester, Birmingham, Bristol or Leeds, wives would receive ongoing maintenance; in rural areas they were expected to stand on their own two feet.

The survey, conducted four years ago by Pannone, the Manchester law firm that is part of the wider Slater and Gordon national brand, is confirmed by lawyers today who say there is still disparity and uncertainty.

Baroness Shackleton of Belgravia, a partner at the London law firm Payne Hicks Beach, said: "Guidance is needed as to the circumstances that maintenance is awarded so that it is not a postcode lottery. Some courts award maintenance for life while — on exactly the same circumstances — others regarded a cut-off as appropriate."

Resolution, the association of 6,000 family lawyers and advice workers, has also conducted a survey of 70 family lawyers, asking if they had "forum-shopped" in the hope of getting a better result for their client. Some 57 per cent said that they had issued proceedings in a particular location or court because they thought it would yield a more favourable outcome. Michael Gouriet, family partner at Withers, said that reform would bring clarity and certainty to those going through a family break-up even though generally the "pejoratively named meal ticket for life" was not as common.
