That's actually a double red herring. I've always been impressed with just how many clues were dropped towards the theory being valid without confirming or denying it at the end.

One of the things never elaborated on was just how Nunnally was able to tell when people are lying. We were just forced to believe that she could, because anime magic. Giving Nunnally the ability to actually see his memories at the end was an intentional choice, but we have no idea if she has always been able to see that far from the start, or if something had changed within her/Lelouch for her to be able to see.

Or maybe it's because she's able to physically see again. Or maybe it's because the writers just wanted her to know the truth behind it all. It's never really explained. Some of the staff said Lelouch was dead at the end, but at the same time, they also said Nunnally was dead inbetween a couple of episodes in R2. As I recall, they even released a chart of who's on who's side and whether they were dead or alive; Nunnally was clearly labelled as dead. The fact that the main author refuses to verify that Lelouch is dead at the end should make more people keep an open mind about the whole thing.
