To put this in perspective - if it was you or me that had shot the guy (someone without a badge, essentially) we would be in prison by the end of the day. When the other party chooses to run away is the point where you can no longer legally claim self defense. When he retreated, he deescalated the situation, so it is no longer necessary to use force to defend yourself. In this situation specifically, the cop should be held to that standard, same as any of us.

it looks like a laser projectile actually landed in the arm of the cop. And he might not have realized the gun is on the ground in those 1-2 seconds in which he made the decision to shoot - if the suspect still had the gun, he could paralyze the cop, even if he gets some distance before.
