When a court blocks something, it's suppose to go to a higher court, but they can delay the shit out of it going up the chain.

Hard to do. Judges are hard to get rid of. I've always thought that rulings should only apply to their district. IE: the block would only apply to states under the 9th district, and could be reversed by a higher court.

They are not litigating for an outcome, they are litigating to prevent an outcome. In my country, exploiting injunctions pendente lite is more than enough to get you, and most of the partners at your firm, disbarred.
