They were still found to have comitted a crime and were still sentenced, all that happened is the aggravating factor of it being non consensual was not present. "Consent" is a legal fiction that is not concerned with whether a person actually consents. The actual consent in this case does not mean a minor can legally consent.
Crimes typically receive stronger or lighter sentences depending on factors like this. If there has been no actual consent then the punishment would have been more severe.
