The prevalence of people with abnormal sex chromosomes is less than 1%. There is no logical reason for gender to be separated from sex, just like there's no reason to have 52 different colors for traffic lights. The reason for sex/gender being separate is dogmatism, not science.

You're right, chromosomes don't determine sex. Not every animal even uses an XY chromosome system, and even in humans, there are some rare anomalies where chromosomes and sex aren't entirely in the combination that one would expect. You ever met someone with two X chromosomes and a functioning penis? I have. They're about 1 in 100,000, but they do exist. While this is pretty rare, it suggests that there's about 6-8 such individuals living in Seattle.
Instead of chromosomes, the factor scientists use to determine whether you're a male or a female is what you can produce in sex. If you produce sperm, you're a male, and if you produce eggs, you're female. Interestingly enough, this does not say anything about what other roles you perform in sex. For instance, in seahorses, it is the males who end up carrying the eggs. They don't produce them, but in effect, they're the ones getting pregnant. As we can see, this simple definition makes it easiest to address the numerous anomalies in sexually reproducing species.
As for gender, it is worth noting that the word originally existed as a synonym for sex. Where it fits now is pretty poorly defined. While many would like it to be changed to be more inclusive of transgender individuals, this should probably wait until we have a better understanding of what actually causes gender dysphoria in the first place. There is something to be said about potential neurological differences in male to female transgender individuals when compared to traditional males, but how significant are these that we can safely say, "this person is mentally a woman."

Intersex is a chromosomal abnormality, but it doesn't create a third sex. If you have two X chromosomes and can shoot off sperm, you're a male. Arguably, the only possible third sex would be a null sex -- someone who is neither capable of producing eggs or sperm either due to mutilation or genetic mutation.
