I'm pretty sure this is already the case in other countries, the Netherlands have always been very lax with copyright infringements, up until a few years ago downloading copyrighted material wasn't even illegal (only distributing it was). I don't think this'll really change anything.

Look at Dangan Ronpa, a translated LP generated enough hype for Spike to justify releasing the games properly in English. They even made off even better by doing individual releases for the PSP instead of the combined release that already existed.

Yeah, legally speaking fansubbing is dubiously legal depending on the country in question, but most of the time its for products that have no official release to begin with.
