In Ontario, what matters is what the provincial family says, not the federal Immigration department which can have their own definition for their own reasons. In Ontario, a couple is common law if they have lived together in a spousal relationship for at least three years. If they have children together, then they are common law right away. And being common law doesn't entitle her to "half yer shit!".
