It basically says that the California Uni system is forcing the Dept of Homeland Security to violate federal law, which is true, meaning the 9th has placed DHS in legal jeopardy. I have only seen language like this once, in the Bush v. Gore case over the 2000 election, because of the looming constitutional crisis of not having a president elect before inauguration day.

It feels like they've already lost on the DACA debate or at least they've gotten a lot weaker on it after the shutdown failure. I don't know that the immigration debate will be the issue Dems focus on as much anymore, at least not in the Senate. And in the House, while Pelosi's 8 hour speech ingratiated her to the Dem base, there were reported cracks in the Dem coalition on this issue and on Pelosi's leadership.
I think the Tax Cuts/Economy/Jobs have pushed the DACA issue further from the mainstream and it's become more about immigration in general which will be a harder thing for Dems to fight since you can't focus on only the "Dreamers".
