Was charged with disorderly persons this past week for yelling from my car “Get off my lawn you fucking faggots” at a group of protesters.
Does the fighting words clause that arose from the Chaplinsky v. New Hampshire Supreme Court case mean that I’m not protected by the 1st Amendment?
Does any other anons have a similar story they’d like to share?
General 1st Amendment discussion thread.
Asher Wright
same, except i got out of my car and beat the shit out of the protesters and the cop high fived me and then asked for my venmo, so odds are you were charged for being a bitch
Grayson Scott
Only some speech. But this is the natural result of classical liberalism. Let it play out; it's all going to collapse under the weight of its own liberalism. The founders were civilizational iconoclasts who paved the road for later revolutionaries like Marx.
Xavier Martinez
Depends on what your protesting and what party in in power where you live
Andrew Peterson
Uh...you can now sue them because nowhere in America is it legal to suppress you RIGHT to say anything you want on your own property. What you said isn't fighting words anyway and if someone says it is, they are fucking fools. You didn't threaten their lives, so you're golden. The cops suck in your area.
Tyler Gray
I got fired from my job because I was dicussing Thomas jefferson with a customer and how he didnt have sexual relations with his slaves.
I worked at barnes and noble.
Seriously, how does a business that operates under US law somehow trump my first amendment right?
Isaac Adams
1. Your story is bullshit 2. Freedom of speech is not dead, you're literally allowed to call a cop a faggot pig and he can't do anything legally 3. You don't own any property, stop calling it "my lawn"
Jeremiah Nguyen
>op was the faggot protestor on the lawn Amazing.
Henry Roberts
That's not what happened. You are failing to convey elements of the story, probably about the manner you proceeded to rudely interact with police in.
I'm guessing that, when you spoke to police, you were hostile and expressed a desire to be violent.
If the story was what you're pretending it is, then sure: it'd get thrown out if you invested in a competent lawyer. Which, by the way, is more expensive than the ticket.
Jaxson Thompson
>
your retarded. you have no idea what your talking about. I dare you to go get a job and freely speak your mind.
>WELL U CANT JUST...SAY WAT U WANT.
>cant say what u want if u want food on your table >freedom of speech isnt dead
okay kiddo
Isaac Fisher
>freedom of speech isnt dead
>can only talk about this on a fucking anonymous Japanese anime board.
John Fisher
You have a right to free speech. Not a right to freedom from consequences for your speech. Your employer had every right to fire you--that's a fireable offense.
Jacob Barnes
This
Jaxon Walker
So discussing a president of my country is somehow justifiable to fire me?
are you fucking retarded? the mental gymnastics of boot lickers are real.
Isaac Gomez
>you can only talk about this on a fucking anonymous Japanese anime board looks like its not dead you idiot, unless you live in bongland where you can be tried for hatespeech
Michael Parker
Sperging out with Sup Forums conspiracies while representing your employer at work?
Yup. That is absolutely a fireable offense. If you'd done that to me, in a Barnes & Nobles? I definitely would have lodged a complaint with your employer.
Eli Parker
Fight the ticket, it's free speech.
I'm an attorney in the state of New York.
There was a guy who paid a ticket with the memo "fuck your shitty town" they tried similar shit, and the guy won.
there is No such thing as fighting words and no such thing as hate speech in the united states.
Angel Diaz
There is, however, disorderly conduct.
And chances are that OP was given a ticket solely because the officers were afraid they'd be back at his house, later, because of the parts of the story that OP left out.
Caleb Lewis
the church for not tipping on a gigantic order, the company for thinking they have the right to police their employee's speech when not at work, society for enabling giant soulless corporations to dictate what people can and can't do by giving them the power in exchange for it being used against their perceived ideological enemies, greed in general as no one in this story cares about anything but money
Cameron Powell
People don't go to the bookstore to hear the political opinions of employees.
Connor Sanders
>be american >tell strangers to leave your property >get arrested
Henry Price
You deserved to be fired for not hiding your power level.
Michael Scott
This is a coward. He believes in things which oppose the status-quo but is too much of a coward to proclaim those beliefs in public in fear of retribution from twitter. This is a coward.
Grayson James
>haha dumb goyim if you have a problem with the OSF protesters the police will detain you because you were angry you had to spend two hours stuck in traffic after a long day at work, and even though a kike lawyer can get you off the ticket, we made sure its cheaper to just plead guilty and pay the zog directly, plus that way your (((DA))) can run for reelection with a 99.99% conviction record >durr you have the right to freedom of speech but only if you don't want a job or any other rights or protections and you don't make any (((marginalized groups))) feel threatened
Ian Baker
He deserved to be fired because no one wants a a cashier-slave sperging conspiracy theories at them, even if we agreed.
It's like people who play music too loudly from their car, with their windows down. Could be my favorite song in the whole world and it'd still annoy the fuck outa me that you were doing it.
Well first off, no: I think your idiot conspiracies are for idiots.
Aaron Parker
Yet here you are, on Sup Forums. If a clerk revealed his power level I'd just laugh in the knowledge I'm not alone in this world and join the banter. Got no backbone or something?
Hunter Morales
You stupid fuck.
Hudson Ward
I am a law student and I wonder if y'all realize how bad things are I go to a pretty good school. The students here unironically (>90% support) want to repeal the 2nd amendment, finish trashing the fourth, further restrict the first, do away with the 10th completely, base everything on the 14th and let Google and Amazon skirt all anti trust law because they are, like, so important Things are about to get much worse, fast
John Hall
I come on Sup Forums to yell at you people because I hate you, mostly.
I'm laughing that dude got fired for being a socially incompetent retard.
Josiah Price
Hide your power level and work slowly toothpaste. I know you have socialist leanings in your country but you can’t be that stupid.
Austin Wright
Prove it you fucking faggot
Oliver James
remember:
PEOPLE LIKE HIM GET THE ROPE ON DOTR
he's nothing more than a neoliberal globalist radical individualist. they ape nationalist and libertarian beliefs but they're basically the reason libertarian paradise would devolve into ancap memes in less than a week.
Isaiah Sullivan
What is a bookstore? EXCHANGE OF INFORMATION.
>we have to play music in every store >katy perry is okay to listen to >having a discussion with a customer about our president makes me liable for termination
Were living in distopian world without a doubt
>I can talk about star wars all day long no one bats an eye. >talk about something real, pertaining to the history of my country fired.
Welcome to the divided states of zombie land.
Juan Miller
This desu. >2 days ago a little girl asked if we sold anything for 18 cents >"let me tell you about the jews"
Zachary Rogers
Pretty much this. Sucks to suck, gotta be alpha these days.
Eli Sanchez
still, as long as he wasn't throwing rocks, and actually fighting them, he will win.
I could stand in Manhattan and use every racial slur in the book, and they couldn't stop me. Stopping me would Just result in a nice cash settlement in a few months.
Angel Perry
This statement is the most weaselly use of a technicality and people who actually believe it should be hanged
Eli Collins
Or OP just made it up entirely Or even more likely OP is in high school and got detention then changed the story to sound less faggy
Oliver Ramirez
Yet I talked to people from all over the world, and have many meaninful conversations.
I also sold the most fucking memberships there so clearly i was doing something right.
A business is not above the constitution. If everyone is gonna get fired for speaking against the status-quo, in fear of not having food on table, is that freedom? no fucking seriously look me in the fucking face and tell me thats freedom, shut up, thats the way it is, and it aint gonna change right???
Go get bent over you spineless zombie. Work.buy.cosume.die Thats the only legacy you will leave for your pathetic offspring.
Caleb Rodriguez
>talking about """"""Sup Forums conspiracies"""""" in public shouldn't be allowed
so basically you admit that freedom of speech should be limited to (((truths))) approved by the zog media and education apparatus and nothing else. that a private company subject to US law should have the right to deprive a man of employment because of a conversation in a book store, where we can logically assume the customer had an interest in history and was likely looking for books on Thomas Jefferson, because they dared to speak about how our third president and the author of our constitution didn't actually rape a women despite great efforts by the zog to promote this as truth.
Christopher Turner
it's not illegal to call people faggots
Robert Taylor
>the government has the right to police your speech if they perceive a possibility you may commit a crime in the future
Brody Jackson
> Telling the truth about historical fact is a firing offense. The purge can't come fast enough.
Jeremiah Long
Politics is the only thing not protected. Race, religion, sexuality, etc are all protected and your employer cannot fire you for any reason pertaining to the above. Politics is fair game. But since everything is politicized, now, the entire classical liberal farce of >muh free speech >muh liberties given by God to have the absolute right to talk shit anything including about God and to destroy the moral law >muh free country is the first secular, godless State in recorded human history but all our liberties were given by God Are you all so dense that you can't see this falling apart?
Eli Scott
So I could get fired if my GM was a hillary supporter, and I liked my president, and made that vocal?
where do you draw the line? Its been blurred.
Easton Hernandez
Yes, political speech and affiliation is not protected.
Jack Russell
>minimum wage worker >misspells multiple words in this thread
I bet you had plenty of “meaninful conversations”
Xavier Brooks
Trust me it most definitely is not up here you can't say half the shit you can say in public there
Leo Murphy
>Seriously, how does a business that operates under US law somehow trump my first amendment right? Corporations are legal fictions. They are created and dissolved by the stroke of a pen. Yet their artificial personhood has superior constitutional rights to your natural personhood because they control the courts, Congress and the administration.
To answer your question, corporations cannot be forced to hire people ignorant of history.
Gavin Allen
>can't be that desperate for change FTFY We don't lean towards socialism. Normies in this country make Stalin look antirevolutionary.
