Yes, its not like there is some criteria you have to fulfil to slap that bullshit on your game.

You could make any game you want so long as it follows the laws of the country you're releasing it in.

I think that I miss the times when the only disclaimers games had described that it had gore, violence and that any events taking place in it are entirely fictional and any similarities to people or events are coincidental.

What is this, a mid-2000s gaming college ad? Truth is unless you're an indie developer, you can't make it the way you wanted. There will always be a staff team shoving ideas down your throat while you're working on your project.

I said you can make any game so long as you don't break the law.
If you make a game that uses explicated images of real children or actually tells the users to go out and commit crimes those are two examples of breaking the law; the US law any way.
So like I said don't break any laws and you can make any game you damn well please. Just don't expect it to be picked up by a major label or to have it rated by the ESRB
