>Zenimax has filed an amended complaint against VR pioneer Oculus, which marks the latest update in a suit that has been raging since May 2014. The complaint, which alleges a variety of transgressions, now includes Oculus CEO Brendan Iribe and id Software co-founder John Carmack by name.
The suit also directly names Oculus parent company Facebook, with amended charges against the VR company that further detail a key source of conflict: misappropriated Zenimax property. Specifically, the filing now spells out theft allegations against the id Software co-founder and Oculus’ current chief technology officer John Carmack.
“Instead of complying with his contract, during his last days at ZeniMax, he copied thousands of documents from a computer at ZeniMax to a USB storage device,” the amended filing (below) alleges. “He never returned those files or all copies of them after his employment with ZeniMax was terminated. In addition, after Carmack's employment with ZeniMax was terminated, he returned to ZeniMax's premises to take a customized tool for developing VR Technology belonging to ZeniMax that itself is part of ZeniMax's VR technology.”

Nah, it was failed kiking attempt to buy their studio. Basically Zenimax and bethesda worked together on this one. Forged a contract where they could legally refuse to finance the game further if parties weren't satisfied with studio's project showcases. And that was exactly their strategy. They made up unreasonable demands from the dev team and then refused to finance the project further. After some time when the development studio ran out of the money to pay their employees Zenimax made a proposal to buy the whole studio for chicken feed and "save" the studio by merging it. Instead of agreeing to the obvious kikery the head of the dev studio refused the proposal. The IP with the unfinished game went to zenimax and beth while the dev team went bankrupt and reassembled later under a different name with most of their former employees. IIRC zenimax pulled the same shit with arcane studio, only arcane didnt refuse.

Business hours are irrelevant. He made something during a term of employment with a company, that something belongs to the company. This is standard practice to prevent proprietary developments from being replicated outside of "business hours" and then distributed freely or to competitors.
While anyone can replicate functions of software with different code, the code itself is also irrelevant here. Carmack has to prove without a shadow of doubt that the work he done with Oculus was performed without using the technology he developed while working at Zenimax as a base, which is something he will be extremely hard pressed to do.
Zenimax is not in the wrong here. Carmack fucked up by thinking the terms of his employment did not apply to him.

Like I said that entirely depends on the contract itself. For example in yorop the company doesn't hold the right to everything you created if that was done outside of business ours without using the tools of the company, but of course there are limitations of what you can and can't do.
