Hundreds of games get away with scripted events, and cut content, in trailers. Have you never watched E3? And the game may not be multiplayer in the traditional sense, but players do impact the game in (meaningless) ways for others.
You shouldn't be allowed to sue someone because they lied about their "art" and I mean "art" in the definitive way, not the pretentious way. No Man's Sky is shit, but its a video game, and although it may trigger some tards, vidya, at the end of the day, is art, just like movies, music, books, tv shows, comics, anime, manga, ect. Its not a product like a car. If a salesperson lied and said their car had seat belts when it really didn't, yea, you should sue.

in my opinion the game changed during development and things had to be scrapped along the way to get a half decent game on the market, but they focused on the wrong things.

Well in Denmark you wouldn't "sue" him like the americans would. We have something called "Consumer Council" which is a government-run agency/instance which are there to ensure that customer's rights are protected, in everything from marketing to privacy concerns and ensure that companies follow something called "the marketing act" etc.
If a company for instance are sending you spam, showing commercial to children which are exploiting the fact that they are young and "naive" or if a store won't take back a product you've bought within 14 days - they would step in and help you out. Often they run the case against the firm on behalf of one or more customers.
They could fine Hello Games if they are not complying to the marketing act. It's important to understand that Denmark (and most scandinavian countries) are different than USA in that the consumer is often "protected" by law. So by default customers are often better off than companies, if you know what I mean. Misleading customers in advertisements are for the most very illegal.
It does require people to complain to the agency - and most people wouldn't do this as they simply "ignore" the hazzle as it's only 60 euro lost. I'm no lawyer and I don't know if theres a case, but my point is that Denmark is very different than USA in many ways - so what is NOT a case in USA might be different in other countries.

A lawsuit could happen. All the videos and written stories of him saying that X was in the game then not telling the buying public that it was either removed,or not even thought to be put in the game. It would be a tough case but winnable.

Granted that I haven't actually read No Man's Sky TOS, but that condition appears to have made become quite standard in recent years. Most games I installed lately had that clause.

The only time I know of a video game company settling a class action suit is when EA got sued for having a monopoly on the Madden and NCAA football games. I got a nice $230 check on that one. But like I said, that was about being a monopoly, not about false advertising.
