It's been on Windows 10 for months. Soon as they tried to put it on the Bone it not only got denied, but taken off Windows 10 as well. If they hadn't have been greedy, they would have stayed on Windows 10 unnoticed.

the roms aren't. Neither are the use of the names and logos.
Basically, legal emulation is totally possible but the industry is afraid of stepping on the toes of the hardware manufacturers, even though that is legal too as long as they don't use the BIOS or advertising materials. This is why you can't play those SNES or PlayStation titles made by third parties even though they have the source code (for the most part) and instead have to wait for much more expensive ports and remakes.

Microsoft added cross platform play to all their games and added mods to games. Emulation could be seen as another yet step in making a more open and appealing console. Microsoft is probably one of the only companies in the world capable of taking on a legal battle from basically every console manufacturer to have ever existed.

I think the main purpose behind this was to set a precedent. Emulation in general is not illegal so there's no actual reason Microsoft should have had to take the emulator down as long as the thing didn't contain any copyrighted code. If Nintendo sued they would almost assuredly lose the lawsuit, the main problem is Microsoft is not willing to deal with a lawsuit on behalf of random people.
The lawsuit would officially set the record straight on emulation but it could also lead to other devs requesting Microsoft do the same for them.

That already happened. There was a PlayStation emulator in the 90s that was sold commercially and Sony sued and lost.

Wouldn't be as clear cut because the Bleem! case hinged on people mostly using real disks to play on the emulator.
I highly doubt the same could be said for people using Nesbox to play Fester's Quest.

Bleem company was ultimately forced to close up shop because the costs of legal defense coupled with the development costs became too much to handle.
Emulation is legal but defending it will still require money.

There was actually two or three of them. Bleem!, Bleemcast(for the Dreamcast), and the Connectix Virtual Game Station for MacOS.
Sony attempted to sue Bleem and Connectix for them but they lost both of the lawsuits. Bleem would later go bankrupt from the legal fees while Connectix got bought up by Sony who shut the whole operation down.

There's a difference between saying Microsoft "could" defend themselves against Nintendo, which they obviously could, and saying they would want to. While Microsoft has a fuckload more money than Nintendo, they have no reason to hurt relations between the two companies.
