If you hack it you can emulate the entire GB and GBA library near-perfectly (isn't it technically hardware for GBA?). It can also do NES, and the N3DS can do SNES. DS games you need a flashcart to pirate, but they're like $20 so don't even worry about that. It's got a good library of games all its own, especially if you like JRPGs, and you can pirate all of them if that's your thing. Get a New 3DS, they have better performance in every game if you hack, are easier to hack, and can emulate SNES.

Don't waste time pirating it, the process isn't very intuitive and you're throwing your unit in the trash with a cancerous CFW overwritting your stock, stable FW. Just get the few games you want, most of them are really cheap thanks to Nintendo Selects program, and Virtual Console is like $3-5 a game.

Regular size or XL doesn't matter, so pick and choose. Just remember that the screen is only 400x240, so you'll be looking at huge pixels.
Old or New 3DS is the big difference. Obviously you'll be making a saving on the O3DS but the N3DS can overclock 3DS games, and plays SNES games better.

If you want CFW, make sure the unit you're buying is capable of it. 10.6 is the cut off point for easy CFW, then as you go through 10.7, 11.0, 11.1, 11.2 firmware it gets progressively harder.
