1) because one cannot afford the game
2) because the game is unavailable (this can be for many reasons)
And the thing to consider is that the volume of piracy most likely correlates with sales, meaning that the parties most vocal about piracy suffer the least as they are in the green either way. The whole point is that piracy violates copyright, the companies complaining about piracy aren't concerned about lost profit as much as they're pissed off that people do not respect their right of ownership. Half the time it's not even the devs who bring up piracy, but the publisher.

Movies are safe to download, music is safe to download, downloading games is a risk that can fuck your life up. Keyloggers stealing CC info, trojans and viruses can be put into these games and most people don't know how to counter these risks. It's like going to a drug dealer that is giving away drugs for free, sure he is a nice guy and is most likely not doing anything bad, but he might be lacing it with rat poison too.
It's a risk that is simply not worth taking unless you are very well versed on computer security (most are not) or are poor.
