They didn't get away with it. Many people were trolled into buying the card for the lulz but Nvidia straight lost the class action lawsuit and had to pony up $30 to every 970 owner.
you're bullshit. I use my 970 to play DOOM and Titanfall 2 at 1440p, maximum settings except for the absurdly large texture packs, and always get around 80 FPS.

Pretty much the only thing this card is limited to is 1080p and second to highest texture setting. Of course that doesn't mean that the false adverting was right.
Dude I have a R9 390 which is around the same tier as a 970 and I can max out every game that matters. This will still carry me for at least a year, depending if there's a game that I really want to play that really needs a better GPU, which is extremely unlikely.

The only game I'm having trouble with is Hitman™, but that's apparently the game's fault for being unoptimized.
I'm still mad that I bought a 970 before the 3.5 issue was public, though.

the 3.5 gb really only imposes a limit to the highest texture setting. The 970 can still nearly max out everything.
The R9 390 can actually into compute performance, VRAM, and new APIs though.
