At the time, CJ thought he was working with the Loco Syndicate. After popping Jizzy, T-Bone, and Ryder at Pier 69, you get word that Toreno was leaving San Fierro via chopper and shoot him down along the freeway.

Of course, Toreno was never on the chopper and when he turns up again at the desert house, Carl acts like he's seen a ghost. That's when he reveals he's a government agent.
