That's true. Depends on when they release the browser, though. The only online games I can think of right now are MK8 Deluxe and Splatoon 2, both of which aren't launch titles.
And if their onboard browser is compatible. Not every browser can handle a wifi gate. Early android phones and iphones had trouble with that.

I can't imagine the throttled speeds and high ping of a Starbucks access point would be particularly good for a multiplayer console game either. At least with a smartphone the only limitation is how long you can play, not whether the game is even playable.

Truth be told, this would actually be a problem if not for the fact Nintendo is probably also going to fuck up the wifi connection process by forcing you to declare new profiles for each network you want to join instead of just keeping them on a list as you join them, meaning it probably won't be worth the trouble to join a network you won't stay on in the first place.
