The Injustice universe works on the flawed premise that a world with the Joker would completely forego the death penalty.

If a person not only has committed multiple mass murders but also has escaped jail multiple times, he would die. He wouldn't just be sentenced to death, a policeman would shoot him in cuffs on the way to prison. Like there is no real earth, operating with people as we know them, where people like the Joker would stay alive.

So this whole 'we don't kill' bullshit would never exist. Batman doesn't kill not because he thinks all people should live and be punished through prison time only. He doesn't kill because it's not his jurisdiction. He respects the police and the government to some degree. But he wouldn't stop someone from being killed if sentenced to death.

I agreed with Superman killin Joker, because killing him would literally save a tonshit of lives, but then Supes hit batshit insane levels with his regime. Anyone who sided with Superman, after he killed Shazam just because he disagreed about killing millions of innocents, is literally retarded.

Killing the Joker was not a bad thing, Batman should have done it long ago. Superman's plan was a short-term, emotionally driven and easily corruptible. An extremist, socialist authoritarian regime that would (and does) quickly create an opposing extremist base. His actions would be creating more and more "supervillains" explicitly out to stop him and keep their heads above water in a dystopian landscape.

If Superman were to be able to continue killing every bad guy with impunity, he would quickly run out of the greatest evils. The second-most evil would then become the new great evil, on and on until he started disemboweling people for jaywalking.
