Legally or not, it technically is. Just like a physical good, digital goods have material costs.
There's nothing wrong with pirating bigger titles like AC or COD or whatever other shitty games that people are still milking. The problem comes when you pirate indie games, passion projects. Even if the dev doesnt need the money, its still a good gesture to buy it, to rewarding him for his good deed. And in a way tell him to keep making good shit.
