Data archiving used to be at premium way back unlike now where you can just dump everything to a couple of cloud services and you'd be 99% safe.
There was also no reason to archive stuff because people weren't really into doing remasters or remakes and those that own the stuff aren't going to pay to keep that shit.

Forgive me, I'm not into programming but can't the source code be obtained from the original game discs? I have a physical copy of Icewind Dale 2 and would give it to the cause.

I'd be perfectly happy to play original IWD2 and I actually installed it and got it working on modern resolution and all except for that fucking fog of war which flickers like a strobo light every time you move the camera. Somebody fix that shit and the original is just as fine.

Getting copy protection for sales of more than X dollars (say... 10,000) should require you to submit a copy of your source code and original art files to a vault somewhere.
After a certain amount of time, if your software hasn't be made sufficiently usable on modern hardware, the archived code should become open source.
