Simply because they were the only option.

It was my backup preorder for the switch, but it ended up arriving in the morning, while the one from Best Buy came in the afternoon, so I ended up returning that one. Also they fucked up and forgot to charge me sales tax for it, so I ended up with a switch for exactly $300 on release day.

Its not illegal for a one or two off situation, furthermore their ToS, which WalMart shoppers agreed to, states they can do this. They have not given a product or service yet. Only a promise of one down the road. And no, a pending charge doesn't count as a promise.
