Let's plays are not a legal right. If a company wishes to take down a video of you consuming their product they should have the right. You can't legally do "let's watch" of a movie, so why are video games okay? Maybe it's because gamers are manchildren that don't know anything about the law? I really hope a large company takes these petulant manchildren to court.
Let's plays are not a legal right...
well, fair use is decided on a per-case basis and there hasn't been one for lets plays yet so no one really knows for sure but the logic that people who think its fair use is that "its a transformative work because every person who plays it plays it in a different way so its different from uploading a movie to youtube"
Their terms of service explicitly state it's fine for people to stream their content. At worst they can tell him to pull it down.
Fucking Firewatch of all games would literally be nothing without Markiplier and Pewdiepie. The second he was found uttering the word, the entire Firewatch dev team should have spammed nigger nigger nigger on Twitter
Hahahaha
I'm sorry, I can't help but laugh. It is absolutely not transformative.
Why would I bother buying a game when I can watch it on YouTube? Let's plays cut into funds.
Legally you're not wrong.
But I think the issue here is that most you tubers have armies of children that jerk them off and give them the impression that they have enough power to change the law so that they can continue to make a living off of their poor excuse of a "career".
the clothes company who made that shirt should sue him for doing a Let's Wear while doing a Let's Play
Alright but forget about the firewatch example for a second. Should it be okay for let's plays to exist?
I say no.
This. I'll not be buying any future Santo Campo games because of this kikery. I enjoyed Firewatch but they can choke on a nigger dick.
i didn't say i thought it was i just said that's the usual argument of people who think it is.
a good argument would be that it's kind of a review since fair-use covers reviews.
>be PD
>says nigger
>has to apologize several times
>be me
>say nigger intentionally all the time as a racial slur not just as an insult
>dont give a shit
am i a chad yet ?
>Why would I bother buying a game when I can watch it on YouTube?
Because you're not the one playing it. Just because you're a retard who needs to pretend he's "playing" games with a fake e-celeb for a friend doesn't mean everyone else does.
They gave express permissions to stream on their web page, you can scream about that no being legally binding but it is express consent which is more than enough for fair use.
A game is different from a movie because you can't get the same experience from watching a game as you get from playing it.
Not an argument. The company that made the shirt isn't losing funds from his "let's wear".
"poor excuseof a career" earns millions of dollars
This. The tricky issue is when monetizing the videos comes into play. Also pewds is a tard. He deserves all the shit hes getting. Glad to see such a cancerous channel die. The only reason you will see people seem to defend him suddenly is because they've spent too much time on Sup Forums people were shitting on him here from day one, lets keep it that way
Reminder that twitch and yt gaming need to be subpoenaed so the streamers can be brought to justice
h3h3 won the lawsuit!! :)
For most games you get a better experience from watching than from playing.
>one guy out of hundreds of thousands
And exception to the rule doesn't change reality but thanks for playing
you are fucking nothing so nobody gives a shit
neither is the company that made that shitty game
the dev even said on twitter that they made money because of pewdiepie
Because the entire fucking point of a game is to play it, how is watching it supposed to be a replacement for that
>be me
>say nigger intentionally all the time as a racial slur not just as an insult
>dont give a shit
Yeah I'll bet you did. The internet doesn't equate to real life social situations kiddo
>gamers are manchildren
That should've been the first signal to stop taking OP seriously.
Wrong. There are a lot of games like the last of us or uncharted where once you see the video on YouTube there's no reason to buy it. You may not like those games but the fact is let's plays cut into their funds.
People might choose to not buy clothes from this brand if they see this racist fuck wear them
All your post says is that you only play shitty games.
And now it's time to discard him. I like their style!
name 50 games that are more enjoyable to watch than they are to play
- Known bigot makes yet another ignorant comment
- His channels are watched by young children, many of whom could possibly be African American or Jewish
- Parents do not want their precious children spouting blind hate
- Advertisers/game developers/TV networks targeting those parents and children do not want their product ruined due to e-celeb disease
I could understand if PewDiePie was running an independent channel and was a literal who, with no advertising revenue, but he's not. On top of all that, he's not even American. If the PC Police want to run a train on him, they are entitled to do so.
If the dev teams allow it, yes.
I'd allow it. Free advertising? Fuck yeah. Undertale And FNAF blew up only because of Reddit and Youtube, millions raked in with almost nothing spent. Though at the same time someone who can afford marketing like Nintendo can tell popular let's players to fuck off and still rake in millions.
I don't think it's yay or nay, it's really up to the developer. If there is nothing stated in documents about the legality of streaming of a particular game then, fine, fuck the streamer in the mouth.
No, you are just so pathetic and insignificant society cannot spare the time and effort to chastise you.
all of them
fuck games
It's still important to the industry. You can hide your head in the ground as much as you want, that doesn't change the fact that let's plays, twitch streams and other online video streaming of games are integral to the game industry now.
The difference between a 'lets watch' and a lets play, is that watching a movie is the main source of the entertainment, so a 'lets watch' of a movie would essentially be piracy. Games however are meant to be enjoyed via interacting with it, so a lets play channel doesn't give nearly the same experience. By your logic, if you make a vlog of yourself at Disney World, you shouldn't be allowed to upload it to Youtube, because it would be considered IP theft.
Because you're watching someone play the game
Show me some actual fucking evidence.
A youtuber getting millions of views for his gameplay doesn't equal lost funds when 90% of his viewers are children who could never buy the game anyways.
Fucking retard.
Walking Sims, DSPs fighting games.
>mad
Good one
You cannot call this screechy manchild a gamer.
does that mean if i watch someone play a monopoly board game, that would be piracy of monopoly?
>Not American
>Say nigger, a word only racially charged in America
>Deserve to be run over
Way to defeat your own argument you moron
>unironically using the word gamer
>projecting
It's true. Celebs, TV personalities, actors and the like get chastised and made to apologize because they are important and might influence other people. You are not.
if watching someone else play the game makes you not want to play the game, then it probably isnt a very good game
video
game
And suddenly not a single complaint about Sup Forums, e-celebs, or the wave of crying posts
really makes you think
>watch cooking show
>now I don't need to eat food because I watched someone else eat food
anyone else loves food analogies like I do? they always makes sense
Yes
>Legally you're not wrong.
No, he's wrong legally. Kkjellberg can, and in my opinion should, take them to court. They can't even fall back on dragging out the case and forcing him into a settlement with the looming threat of legal fees piling up
"Hey, wanna come with me to Japan?"
"Nah, I've seen a video of it, actually going there would be no different."
You've got it right. Let's plays evolved from reviews and playthroughs. Neither of those things are illegal.
Preventing someone from doing let's plays, reviews or playthroughs just because your political beliefs aren't aligned is straight up moronic.
If lets plays instantly became illegal youtube would go bankrupt overnight.
the majority of content viewed on yt is still letsplays
Yes actually. Thankfully board games aren't a multi billion dollar industry.
he made his name by playing vidya
Won't somebody PLEASE think of the children?!
tru
Fucking terrible examples.
this guy you replied to isnt me. like i would waste time replying to that shitty post of yours
I unironically wish death on you, stupid redditor.
Didn't you know? Watching an unboxing video makes you liable for theft of said product.
Explain how they're different from saying that watching a game = playing a game?
in this case, the devs specifically said that anyone is allowed to stream the game and monetize their videos
and now they're sending dmcas because someone did something that they said anyone could do with the game
>You can't legally do "let's watch" of a movie
Yes you can, you just can't show the entire movie because then you're also copying and distributing the movie. A game isn't just the moving images.
>Let's plays cut into funds.
Source
God, now I really hope this happens!
One is a location that changes constantly, the other is a game or movie that was made by a company. They deserve their pay.
I actually want to discuss this. It was brought up in class today as well I study a field in the industry ie programming
A bunch of feminist women were going on about how "disgusting gamergaters were attacking him for this"
They brought up the usual words of manchildren, toxic males, the common suspects.
They thought it was entirely justified to personally ban certain people from playing a game just because they thought Pewdiepie was a "nazi".
This is the state of the industry.
Book circles are not a legal right. If a company wishes to take down a book circle of you consuming their product they should have the right. You can't legally do "let's watch" of a movie, so why are books okay? Maybe it's because book circler's are cat ladies that don't know anything about the law? I really hope a large company takes these petulant cat ladies to court.
Yes, if someone plays a game someone made, and the makers are asking for money for the game, they should be paid.
But watching =/= playing. Again, the question is, how does watching = playing?
BOOK CIRCLES
DON'T CUT INTO FUNDS
YOU STUPID MOTHERFUCKERS!
>society
yeah.. sure, it's society at large that does this, not some propped up loudmouths and their media butt buddies.
The point is all the people whining about Sup Forums aren't unbiased people who care about the boards, they are just the other side and are okay with their side's representation being posted.
Firebitch shot himself in the foot by telling everyone they can stream the game and make money from it. He can't then go autismal and change his mind after the fact.
Why is this a strange mixture of trying to think of ways to use the letters and just throwing whatever out there
Because you are ingesting the product. You might not be directly playing it but you are still consuming the product.
(((You)))
The equivalent here would be watching someone reading a book and having them talk about their reaction with commentary. Ofcourse, the reader will only have to tell certain parts and half the time not even finish the book.
>programming
You can go burn in hell.
>I said ie programming.
>wanting the backbone of the industry to burn
No, the equivalent is watching a movie online for free with some asshole "commentating" over it.
You're still consuming the product.
So is it fine if I make, say, a game circle, and play a game with commentary to members of said circle?
Reminder to people here that this shit is monetized.
A lot of analogies are discussing people using their personal property how they see fit. These people aren't book circling or having people watch them play with their pipedream extreme for millions without permission.
Are you uploading videos of you doing that so massive amounts of people can view you? Are you making money off of it?
If so then it's absolutely not fine.
so if I show a video of me driving my car the car company can take it down?
You are consuming it through any means, whether someone reading outloud a book to you, or watching a movie with friends.
The consumption is the experience of the game, that's why it's beneficial for let's players to play your game. It's a chance to show people how fun or immerseive your game can be.
If a dev doesn't understand this, or even anyone interested in video games, that's their loss.
>i type nigger on Sup Forums i'm a cool guy
No, I'm drawing a direct analogy to a book circle - so small-scale and not monetized for profit, though I wouldn't rule out a kind of membership fee to acquire new games as a possibility.
It's a fucking game. I can't consume it unless I'm playing it.
Sure I understand if devs of shitty walking sims get pissed that Let's Players """""play""""" their """"""""""""""""games"""""""""""""""""" on youtube but fuck those guys. Should've just made a movie instead and this wouldn't be a problem.
But you aren't. You're ingesting the game as much as spectators in Wrigley Field are playing baseball. Watching a game gives very little of the full experience. The point of a game is to present some sort of challenge or some heavily interactive format of storytelling. Both of these are stripped away when simply watching. Therefore, the viewers are not consuming the product, they are merely spectators.
It's a fucking stupid idea but no legal reason you shouldn't be able to.
When it comes to monetization, then I can agree that it should be left up to the developers discretion if the person should be allowed to profit, within reason, but nothing beyond that.
>I get triggered by naughty words on the internet I'm a virtuous guy
>a code monkey is the back bone of a fuckhuge industry
Shove a stick up your ass.
a DMCA claim because someone said nigger is abusing a system that was made for serious copyright infringement. They have the right to have the video removed but use the proper channels instead of abusing a system trying to protect the IP holders (copy)rights .
No I'm just saying, you saying nigger on Sup Forums is not like you're saying nigger at school, work, in public like pewds.
>without permission
This happens to be the one instance where he DID have permission as shown on the devs site.
Personally, I can't wait until it becomes common place and completely destroys the Twitch and Youtube gaming communities.
> Faggots crying about having to buy a streaming license and give a cut to the developers before they can even broadcast a new game.
>make your job completely depend on popularity and how many people watch your stuff
>whoah how dare people scrutinize my behavior
Devs aren't in the right here but Felix should realize there's a downside to making money off of putting your face everywhere.
You're hilarious dude. Holy shit just leave this place.
again
