Piracy is only an issue if the console is very old or not the top seller.

That's hard to quantify, the Wii's fad status inflated console sales, it's possible that a lot of piracy was done by people who only owned a Wii because of its fad status. They otherwise might not have even bought the game had it not been so easy to pirate.
