in case you missed the memo, MGS5 games retconned and swapped ALL weapons and vehicles into frankensteins, mixing various IRL elements. It still is clearly inspired and works like Hinds.

The entire reality of both MGS5 games is fake as fuck. Ironically, it fits the games' themes and end fate.
But after 20 years of /k/ommando-tier gun porn and -autism, especially that sweetass, huge Cold War weapon arsenal in PW, the franken-guns in Vwere quite meh. Even more so since almost everything else is fairly era-correct, like the soldiers' uniforms.

Most of what made MGS cool was forsaken by Kojima so he could spend money on Kiefer and pictures of some dutch girl's feet.

Apparently, it was mostly two things:
1) Allowing the crazy-ass customization we got in the final game, without it looking totally stupid, and
2) There was apparently going to be a deal between KojiPro and some Jap airsoft gun manufacturer, that was meant to create replicas of MGSV's guns. This never came to be.
The "licensing fees" has never ever been an issue. As long as you don't name weapon manufacturers (ie. HK, Colt...), you are fine. Military designations, like "M16", "M4", "StgXX"... etc, are totally free for anyone to use, and that's how even MGS started to name their shit after MGS2 or so.
It's not like you ever use any of the lethal weapont because you'll just get penalised anyway

You could use lethals in non-lethal manner in MGSV, and I sure as hell dropped every heli with a rocket to the nogging.
But yeah, that's one more thing I prefer PW over V: those AI bosses gave you a guilt-free chances to use your expansive arsenal.
Going "BRRRRRT~!" with an MG3 was satisfying as fuck.

When do you ever NOT get penalised for going lethal in MGS?
Phantom Pain actually gives you leeway. You are only denied certain bonuses, so if you can compensate for that, say, by landing a lot of headshots and blazing through the mission you can still S-Rank.
Also the Skulls fights do invite you to go nuts.
