Top isn't considered gambling because each patch contains a set number of cards with at least 1 of them being of rare. Without this one guaranteed rare card it would actually be considered gambling.
Second down is considered gambling if the value of the prize exceeds a certain value.

Not exactly sure of the 4th one but if I'm not mistaken it's contents are not random, they just periodically change and you don't know whats inside until you open (but everyone who buys one at the same time will get the same stuff inside).
