I think Piracy by itself isn't a bad thing. It is, in fact, a healthy thing for the industry.
The problem is the people that abuse it.
I pirate games that I am interested in, and if I enjoy them, I buy them. To me, pirating is just a method to get a demo.
The moment companies lost the confidence in their own games to the point where they stopped distributing free demos was the moment I started to pirate shit.
OF course, there will always be the assholes who pirate games, enjoy them and refuse to support the developers, even the indie ones that make good games. While I wouldn't call it stealing, to me those people are leeches in the industry. They just take and don't give anything back. I won't even call them parasites because at least some parasites are helpful.

Piracy doesn't impact sales. The only media industry is severely negatively impacts is the music CD industry at about 17% lower than expected sales.
Human aversion to criminal practice is primarily due to the perceived risk of getting caught rather than the actual punishment, except in a few unique cases mainly relating to homicide.
The perceived risk of being caught for piracy is incredibly low. Basically no one things they're going to get dinged for it. So it's near as rampant as it would be without punishment and basically as rampant if it was treated as a minor crime.
At this point the law is consuming government resources and increasing bureaucratic complexity while not providing any benefit. If the ability and will to enforce piracy was stronger then we would see different shit happening, but yeah.
