Well I don't know the nuances of Eternal Darkness' copyright, but I do know you don't have to own the company making your game to own your game's IP. Intelligent Systems is independent of Nintendo but that doesn't mean Nintendo doesn't own Fire Emblem.

That's not really true, if an argument over ownership of a character were to be used in court, it would be over whether the character was owned by a publishing first party or a collaborating third party. The second party in the most literal sense is actually you, the consumer. If you think of this in terms of how stories can be written, it should all make sense to you. That should properly contextualize what it means to be the first, second, and third person.

Well I'm not sure, user. Did they have claim over Rare's IPs at the time? If so, then it was first party. If not, then it was third party. IP ownership is all it really comes down to. A game made by the console manufacturer or its subsidiaries, the first party, consumed by you, the second party. A game made by an outside developer, a third party, for a console maker, a first party, consumed by you, a second party. That's the most literal definition of the term.

There's nothing wrong in using "second party" to describe a game with weird ownership or development around it but it's not an actual term to describe the business of development and consumption.

Keeping to first party, no re-releases, and 3 per system is rough,.I missed out on 2 of the best games of all time (Killer 7 and Ghost trick) and really had to stretch for the 3DS first party titles. It's a good list, but in no way perfect, missing some real gems from the NES, SNES, Gamecube, and Gameboy advance era even still keeping to first party.

The IP is and was owned by Rare. The company was a subsidiary of Nintendo. So was the game first or third party, since I assume we can both agree that it can't be both.

Well from a legal standpoint they would probably be considered first party but under a loose contract. The deal meant that anything developed in house by Rare was under their copyright and then property of Microsoft.

Now things can be different for every developer, but Gamefreak for example has the ability to make different IPs for different systems under certain circumstances, just not Pokemon without Nintendo's permission. It's possible that Rare was under a similar bind with anything original they developed under Nintendo's umbrella, until the Microsoft buyout that is.
