Lots of places have laws that allow for you to keep the item if the rightful owner doesn't claim it within a certain time period.

After that, you'll have the device again AND documented evidence to say it's rightfully yours - then you can just head into the Apple Store and have Apple reset it for you (they can't 'unlock' it, you aren't the rightful owner of the data nor do they have the ability, but they'll unblock the icloud lock and factory restore it for you)
