Only if there is a contract(ToS) you sign, which states that ISP can do whatever they want with your data. Btw, they shouldn't be allowed to do that in the first place, as we are paying them for using their service and privacy, not for them selling our private data jeopardising are privacy

ToS also protects the user from throttling though, you pay for the service you pay for and if you can prove they aren't providing that service, you can sue them.
