England had a similar problem in 17th century. The outcome was the "individual" being murdered while the position remained - but of course substantially changed by events.
In my view the Emperor, as any monarch, is truly sovereign and so he can do whatever he wants. He is above the law because he owns the law (even if "law" has been imposed that says otherwise).
