Because when you say "PS4OS is based on FreeBSD" that simply means that in order not to develop everything from scratch, they began by taking FreeBSD as a basis.
They certainly did develop much proprietary stuff and invested much effort in it.

Drivers aren't part of the kernel per se. They only get loaded by the kernel as modules.

They can also be compiled as part of the kernel, but anyway that's not the issue. As said, proprietary drivers on Linux isn't a problem in itself (if you don't directly link with GPL'd code), but it is a legal gray area if you distribute Linux with your proprietary drivers already built-in/part of your bundle.
