Nope, fileservers are legal in my country - law protects downloaders and server providers have to comply with _proper_ DMCA and don't work with _intent_ to server copyrighted content. It's pretty gray area that works very well. Torrenting breaks things due to it's download/upload nature and since you upload specific file it's that intent thus makes it illegal.
But again - country by country. I'm not even sure this is EU-wide.
