Cap is fundamentally right, but he took his stand in the least logical and practical way possible. He didn't have a conversation about how to deal with the Accords because his old girlfriend died, and then he complains about them?
He never bothers to explain Bucky's situation until everyone is already lined up to fight. When given the opportunity to tell stark he captured Bucky, he literally says no - despite the fact that apparently any old asshole can reactivate Bucky's brainwashing.
Yes, the Accords would have led to unnecessary bureaucracy and corruption and misuse. Yes Tony was acting out of impulse and a guilty conscience. Likewise, Cap's team fucked up in Lagos hard but Tony is the bad guy for wanting some kind of oversight?
Besides, Tony is absolutely right - if they didn't sign the accords now, the governments of the world would eventually come after enhanced individuals without an olive branch, but with cuffs.
I agree with Cap fundamentally, but he handled it the worst possible way.

You apparently know nothing of how the law works.
"Temporary insanity" is for a court to decide with the input of a medical professional. By aiding and abetting a wanted fugitive (even one with proof of his innocence), Cap was himself a criminal and blatantly on the wrong side of the law.

Why not hand Bucky over to Iron Man at the airport, and with that gesture of good will, detail everything to the Avengers to go stop (what they thought at the time) the rest of the Winter Soldiers.
