If someone were to find out, or complain about findings such as notes, the authorities could legally step in. At that point they can reasonably suspect that he is going to commit a crime. The authorities probable cause to exercise legal action against him would be the physical findings, such as the notes.

At the point you plan it, it's considered conspiracy, as you've met the Mens Rea (mental guilt) aspect of crime. You would be charged as though you were going to commit it, then you'd be arguing in court.
