The simple answer is that when it comes to electronic crimes, our laws are HORRIBLY outdated.
You have to prove, beyond a shadow of a doubt, that the person acted with intent to violate the law.
When it comes to computers not only is the law ill-prepared as things like "deleting" aren't EXACTLY specified in "destruction", but you can't prove intent when 90% of people are incompetent enough that they don't know how to turn on Microsoft Word. People can just say "it was an accident" and there's literally no way to prove they're lying.
99% of the time when people are convicted of computer-related crimes and go to jail, it's because they're charged with something else entirely. Usually tax evasion.
