Well, Penn's performance is arguably - ARGUABLY - better and a consequence of a much harder work (mental, that is) than Rourke's, who pretty much depicted himself in The Wrestler. While you may oppose that, a simple peek into his life confirms that and it's pretty much a fact.
However, Hollywood is all about lobbying, just like politics, and I'm sure the Academy didn't pick Penn because of those reasons.
