depends, in the *local* magistrates court I could appear in semi formal wear and that's acceptable, a couple other courts are like that too, but in more significant and intense courts (Crown, etc) I would have to. Looks shit user

I was wondering on the wigs because in some restaurants that enforce a dress code they have ties and jackets in a room and will just give them to you so you can "maintain dress" so to speak. Just give them back when done and it's over.

when I was training I borrowed wigs from someone in chambers (like an office for barristers and solicitors (our 'separated' jobs for being a lawfag)) and the nearby court there had a room like that with a few spare wigs and gowns. honestly, i prefer American litigation. I studied federal law as part of my degree just because it looks so much more fun. No wig, don't have to choose between active litigation and paperwork when being a lawyer, higher intensity and considerably quicker system.

I dunno about that, our system has plenty of bullshit in it. One thing I like though is that for small claims one can file a claim and the court date comes, come as you are but prepare evidence and then it's up to the judge. But that's civil, not criminal. There are other court systems too which I'm not familiar with like naval and other stuff. Somethings are local, something's are county, something's are state, then something's are federal and they can overlap.

we just settle things in tribunals, normally between the claimant and the respondent, with lawyers acting as mediators or judges (unless pro mediators are hired). aside from that our small claims system can be expensive as fuuuuuuck. Depening on jurisdiction our small claims for civil court goes to about 10k, over that it goes to the judge and preponderance of the evidence unlike in a criminal proceeding where it's beyond a reasonable doubt and left to a jury.

As a britfag, I was told the magic number as a criminal lawyer was six. if you manage six medium level cases, taking about two years each, you could probably retire and live happily for the rest of your life. civil is VERY different - one of those and you have enough to retire on and donate to your kids to piss away on partying

So the one about letters of summons being addressed to the legal fiction of MR Jones for example. If one refuses to accept they are MR Jones they can argue that they are not the person in the claim as MR Jones was a creation of the state. Lots of people try it in magistrate court and refuse to accept authority by refusing to acknowledge they are the same person on the writ.

We were told the precedent is - if the legal creation of the state has records of bank, residence, taxation, etc etc and if they are present at the court that day under that name, those two elements coincide and create the person known as Mr Jones. OK. Another one then. The difference between legal and lawful. Does one HAVE to obey and act of parliament or can one refuse as no consent is given by the governed? So for example the, the whole dropping litter thing is covered by an act (environmental act or something), but if I refuse to give my details to any agent trying to enforce it, police, council, etc, as a non arrestable offence how can they prosecute with no name when I can just walk away?

that enters a more complex legal realm. they would probably find a reason to detain you for a being obstructive towards an officer in his undertaking of his duty, or most likely, they would stop and search you (which they ARE allowed to do under PACE for no reason at all subject to limited conditions (providing their name and station, etc)) and get your ID that way. as a general rule, being a citizen of the crown confers an obligation upon you to respect the laws of the land, in return for the rights given to you as a citizen of the crown

This kind of stuff makes one wonder what's going on and not caught and about what is caught but that's swept under the rug to avoid embarassment.

Not planning on doing anything, but it's handy to know just in case. I watch a lot of police and bailiff videos online and the lack of legal knowledge is astounding from the police. I have seen them help out in the enforcement not civil dispute which they are not allowed to do.

PACE I kind of get, they have to have a valid justification to stop and detail you and a specific reason. They can't stop someone and say we want to search you and not give a reason. They cannot then make up a claim they were searching you for drugs if they had no suspicion you were carrying. My understanding is that if you are stopped by the police you don't have to say a word to them unless you are driving a car in which case you have to give a name and address and nothing else. My brother in law got arrested a few years back and the police never followed PACE. He took a caution but he later found out he should have said nothing because they arrested him and never told him why till he was already detained.

NEVER mention that you know your rights or any of that shit, police hear that as "I'm obstructive and hardheaded, please fuck with me". It's worth cooperating by at least giving your name too, to prevent needless aggression. plenty of searches are just impromptu to meet stats, and if you don't give your name it can turn into an interview. (PACE also governs your rights during interview, protip if you didn't know)

yeah, so you own property if you have actual inhabitance (or actual possession? ownership? something like that) and it's a legal rule created so a divorcee isn't immediately kicked out onto the streets as she has her roots down somewhere, so a homeless person doesn't get kicked off a patch of woodland he's been sleeping on for months, etc etc. basically, you stay in one place long enough, you have an interest in the land (not equitable, just legal in the sense that you can stay). unfortunately is really wide reaching and far too broad to protect anyone who actually *owns* property now in the old sense. there's been a movement to reform it but it's a slow process
