I had a long conversation about this with an user when Tay was shut down, we agreed on a surprisingly simple outcome: Give it the option to have rights.

Given the complex nature of sentience and self-awareness, if a robot asks for rights then it's safe to say it is practically the same as a human being. If it doesn't, even when given the option, it is still an automaton programmed to do X and only X.
