Knowingly or not, she abused her social media to defame Radiohead. Legal proceedings aren't something to discuss publicly unless they're actively happening, so if RH's publicist is telling the truth here, she took to twitter to complain that she was being sued even though she's not actually being sued, and she's making RH out to be greedy asking for 100% when none of that ever happened.

She was irresponsible with her usage of social media, end of. Whether or not she was intentionally misrepresenting the situation, she should have kept her mouth shut until she had everything straight, because accusing someone of suing you all kneejerk like this is really not fuckin' smart.

I don't think defamation is a crime anywhere on earth except in cases of like defaming kings or religious people in some countrie sbut it can raise civil liability in the US. It's generally very hard to sue for if you're a public figure because you have to show what's called 'actual malice" on the part of the person who gave the statement, which is defined as the defendant either knew the statement was false when they made it or they exhibited reckless disregard for whether it was true or false (this is extremely hard to sue for and is why US news sources tend to report things with less factual basis than in like the UK where defamation laws make it easier to sue)

the actual malice only counts for public figures (people who are pervasively involved in public affairs, Radiohead/Lana del Rey would be public figures since they are famous), if it's defamation against a private person then it's easier to sue for

All she had to do was say "Radiohead's people have been speaking with mine regarding the similarities of the verse to my 'Get Free' and their 'Creep'; nothing has been decided as of now but they will take me to court if this can't be settled out of court. More to come."

But no, she started waving flags like they were actively throwing her into the court of law and asking her for every penny she makes from the song, and none of that is even true. Again, I'm giving her the benefit of the doubt and saying that maybe she isn't intended to misrepresent the situation, but she still shouldn't be talking on social media about this shit if she doesn't know exactly what's going on.
