The sanctuary cities ban is being challenged under the 10th Amendment. The federal government can't force state and local governments to enforce its laws. It's the exact same reasoning that got the DC handgun ban ruled unconstitutional, and you can bet that the federal government overstepping its boundaries is something that would get support from both liberals and conservatives on the Supreme Court

If the federal government passes a law, they're the ones who have to enforce it. State and local jurisdictions can completely choose to ignore it and do nothing if they see someone breaking the law.

This is why you have so many federal policing agencies (FBI, DEA, ATF, etc.) that focus solely on enforcing federal laws. This is why these agencies are constantly getting into quarrels with state and local cops.

It's also why you had so many cases under Obama of the feds wanting one thing that flew completely opposed to what the states wanted. The federal government still doesn't recognize recreational or even medicinal marijuana as legal. The DEA still does raids on marijuana dispensaries in states where they are legal. This is exactly the same situation as the sanctuary cities: there's a federal law that the FBI and DEA are trying to enforce while state and local cops completely let it slide.

Trump's executive order forces state and local police to ignore state and local laws and follow federal laws instead. This is blatantly unconstitutional. If Trump wants to send ICE into Los Angeles and find illegals and arrest them, he'd be within his constitutional limits. If Trump says "California gets no monies unless the California highway patrol enforces federal laws" he's getting a one-sided Supreme Court case telling him to fuck off

California can't declare "we want more immigrants" and pass a law dissolving the border with Mexico, nor can they declare "no more immigrants at all" and build their own wall and have their own screening process. It's all down to federal law.

Meanwhile, maintenance of schools and roads is a state issue which is why sanctuary cities allow illegals to get driver's licenses and go to school. It's a completely different system and makes sense from a harm reduction strategy
