I'm here reading all the bullshit excuses about appeals and due process. That's fine and all, but all death row convictions are well considered and have insurmountable evidence. Jurors tend to freak out when having someone's life in their hands. About just over 1% are exonerated, but exoneration doesn't mean unadulterated innocence. It's normally because of a mishandled case, or the prosecution charged them with the wrong crime. That said, we are so full of litigation there are so many varying degrees of crimes that it's difficult for prosecutors to determine which crime to prosecute under.
So for all intents and purposes, people on death row are guilty. You might cherry pick that one case, way back when, and appeal to emotion. In that case, there should be a huge outrage as to how the fuck someone was able to fuck that up so bad, knowing how sophisticated the court system is.
But Op brings up a very good question. Nobody has a good answer, which is why it keeps getting brought up. The real problem is the inefficiency of the court system. Appeals should be immediate. It shouldn't cost more money. These are high profile crimes, and should be handled as a priority. Why the fuck do we, as the public, get the feeling these things are sitting on a desk collecting dust?
